The National Treasury SCM Instruction Note 3 of 2021/2022 marked a significant departure in the requirements for PFMA organisations when deviating from a competitive bidding process.
Amongst many requirements, the instruction now requires an institution to include at a minimum the following in their SCM Policy:
- a plan to curtail reliance on procurement by “other means”
- circumstances under which each procurement by “other means” may be utilised
- processes to be followed in respect of identifying prospective suppliers for, and recording and approval of, procurement by “other means” and
- assessment of all instances that gave rise to procurement by “other means”
This 1-day workshop explores the legislative background preceding this instruction including various legal cases and proposes a framework for making sound and rational requests to the relevant treasury.
