This is not your standard BEC training. This practical one-day workshop is for experienced SCM professionals who already understand the basic roles of a bid committee. We dive directly into the complex challenges and grey areas that National Treasury Guidelines and unit standards don’t adequately cover, drawing on facilitator experience, local court cases, and international best practices.

You will learn to apply Constitutional Court principles to materiality, navigate difficult pre-qualification criteria (like affidavits and SANAS certificates), and confidently address issues like abnormally low bids, expiring proposal validity, and “market-related pricing” within the PFMA, MFMA, and FMPLA frameworks.

WHAT DOES THIS COURSE COVER?

  • Materiality: Understand the principles to be applied in deciding a material non- compliance. The workshop will use the principles developed by the Constitutional Court.
  • How to deal with bid responses where the bidder answered “Yes” to some of the questions in the SBD 4 or MBD 4 declaration or other issues emanating from the completion of the declaration.
  • Understanding the principals and practices underlying “evaluate independently” and what to do when the BEC decides that scores may need to be changed
  • What are the accepted practices when dealing with abnormally low bids (when the price of a bid is abnormally low, but the bidder has submitted an acceptable proposal (meets the minimum threshold for functionality)?
  • Considering “market-related pricing”. What are some of the considerations when the Bid Specifications Committee (BSC) did, or did not, assess prices in the market?
  • The treatment of arithmetic errors, omissions and discrepancies in a bid submission
  • Considering Objective Criteria (in terms of section 2(1)(f) of the PPPFA). The workshop will consider examples of Objective Criteria that the courts have used in the past 17 years when dealing with section 2(1)(f) and the implications for BEC members.
  • What steps to take and other considerations to consider when the proposal validity date is about to expire?
