Deviations from open competitive bidding are permitted under the PFMA and MFMA, but only if they are properly justified and approved. While legislation provides examples like “urgent cases” or “sole supplier,” what does “impractical” truly mean? This workshop moves beyond the basics to give you clear, defensible answers.

In this interactive 1-day session, we explore the nuances of deviation. You’ll learn what the courts have said about “urgency” and “foreseeable” conduct. We will clarify the critical difference between sole-source and single-source, and unpack other practical, internationally recognized examples of impracticality.

WHAT DOES THIS COURSE COVER?

  • Understand the legislated context to “deviations from competitive bidding” and some of the importance historical practice notes and instructions on institutional policies. Also to understand the erratum clarifying the quotations threshold confusion.
  • Understand what is meant by “other means” and how to distinguish between other means and circumstances (such as emergency and sole).
  • Understand “sole source” and the possible circumstances to include in an SCM policy.
  • Understand “single and multiple source” circumstances and the examples where they may be relevant.
  • Understand “urgent” and the case law that provides the basis for urgent circumstances to be included in SCM policies.
  • Understand “emergency” circumstances and also how this may change under the Public Procurement Act of 2024.
  • Understand the possible policy provisions that can be included to comply with the additional requirements of the Instruction regarding “curtail reliance on other means”; “identifying prospective suppliers”; and the “assessment of all instances”.
