There is also a risk that the delivery of the goods or services may be suboptimal or not cater to the actual business requirements if the specification has certain shortcomings. The legislative context under which Bid Invitations fall (the PFMA, MFMA, SCM Regulations, PPPFA, and the B-BBEE Empowerment Act) can be complex, misunderstood, or misinterpreted. This course explores the key elements for developing effective and compliant bid specifications and outlines the attribute of an effective and compliant specification.

WHAT DOES THIS COURSE COVER?

  • Understand the key definitions and historical background to Bid Specifications and Bid invitations
  • Understand the legislative context in which Bid Invitations are required and how this differs for different organisations under the PFMA and MFMA. The legislative context includes the PFMA and its Regulations; the MFMA and SCM Regulations; the current Preferential Procurement Regulations (PPPFA) as they relate to Bid Invitations; and the Broad-Based Black Economic Empowerment Act (revised) and the Codes
  • Understand the role of the Bid Invitation and the impact that responses by the bidders have on the contracting process
  • Understand the establishment, structure and role of the Bid Specifications Committee (BSC)
  • Provide a clear understanding of the different types of bid invitations (goods and services, terms of reference, infrastructure)
  • Understand market/industry research and analysis in the context of bid invitations and review the use of Porter’s Five-Forces model (and others) in industry/market as an analysis technique
  • Understand the strategic sourcing options to be considered before embarking on a bid invitation process, including considerations such as what to procure (scope, duration of the contract, nature of the contract, etc.) and how to procure (procurement methods)
  • Present a framework for organising and compiling bid invitations
  • Understand the legal concept of “substance over form” and how to stipulate requirements and evaluation criteria that minimise legal challenges after the award
  • Understand the difference between conditions of tender vs. conditions of contract
  • Understand what constitutes an Acceptable Bid
  • Understand the importance of the institution’s preferential procurement policy in determining the preference point score and what to consider in formulating these requirements in the bid specification
  • Understand the purpose of the General Conditions of Contract (or related) and the relationship with Special Conditions of Contract and which Standard Bid Documents (SBDs) are typically required and when
  • Improve your skills in writing effective Bid Invitations by understanding important terms to include and what to avoid
  • How to check the Bid Invitation prior to submission to the Bid Adjudication Committee or final authorising structure; and
  • Understand the role of the Bid Adjudication Committee or similar in approving specifications
