WHY CHOOSE THIS COURSE

The Preferential Procurement Regulations 2017 lapsed in January 2023 and were replaced with new sparse regulations. The Minister of Finance has announced 16 January 2023 as the date. These new regulations leave it completely to the organ of state to determine its preference system. The new regulations will only prescribe the 90/10 and 80/20 threshold and the price formula.
 
Organs of state must develop a preference policy that will determine how suppliers will score their preference points out of 10 or 20. Should the B-BBEE scorecard continue? Can other criteria such as locality, women ownership, innovation, sustainability, and other factors be considered?
What about the treatment of functionality and other aspects not included in the 2022 regulations? Organs of state may want to have draft policies ready for approval in November 2022 or in early December 2022. National Treasury has announced that the new regulations will be effective on 16 January 2023.
